  • Grossman LLP Defeats Lender’s Effort To Dismiss Lawsuit Over Christopher Wool Artwork

    This week, the Grossman team obtained an important victory in yet another case arising out of the fraudulent schemes of disgraced art dealer Inigo Philbrick. Our clients in this litigation were part of a group who, at Philbrick’s behest, co-invested in a Christopher Wool artwork.  After selling them each a share in the artwork, however, Philbrick stole the painting and purported to pledge it as collateral on a loan from Athena Art Finance, a fine-art lender.  After Philbrick’s fraud came to light, our clients asked Athena to return the artwork (or at the very least recognize their ownership interests), but Athena refused.  After we filed suit, Athena asked the court to dismiss the claims as untimely.  But yesterday, a state court judge sided with our clients, holding that the statute of limitations did not begin to run at the time of Athena’s loan, but rather, when Athena refused to return the work following our clients’ demand.  We look forward to vindicating our client’s rights in this artwork, just as we have done in multiple lawsuits on behalf of other victims of Philbrick’s fraud (see here for another recent victory).
