Gifting Artwork Is Not Always A Simple Matter
03/05/2013We wrote yesterday about the legal considerations raised by a museum’s accessioning of artwork. In today’s New York Times, Patricia Cohen discusses additional issues that may arise when museums are challenged with trying to honor “donor intent.” Once again, the best way to try to avoid any issues before they arise is to consult counsel to ensure that a comprehensive agreement is in place, clearly spelling out a museum’s rights and obligations, as well as all restrictions on the use or display of the works.
